RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMEND I NG �`HE GRANT I NG OF A VAR I A�lCE
WHEREAS the Planning Commis�ion of the City of Cupertino
received an application for a VARIANCE, as �tated on Page 2;
and
WHEREAS the applicant has met the bur�den of proof required
to support his said application; and
WHEREAS the application shows:
l. That there are special conditions or exceptional charac-
teristics in the natur�e of the property to be affected,
or tha� irs location or its surroundings a�re such as will
permit the Commission to make a determination that a
lite�al enforcement of the Ordinance would result in prac-
tical dificulties or unnecessary hardships; and
2. That the gra�ting of the application is necessary for the
preservation �nd enjoyment of substantial property rights;
and
3. That the hea�°ings �how that the granting of the �pplication
will not materidlly affect adverse'y the health or safety
of persons residing o� wo�king in the neig�bor°hood of the
pr which is the subject of the application, and that
fihe use of �a i d pr°ope�rty i �n the manner i n wh i ch i t i s pro-
posed to be used will no� be materially detrimental to
the public welfare or� inju�ious to the value of property
