RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE DENIAL OF A VARIANCE
WHEREAS the Pla�ning Commission of the City of Cupertino re-
ceived ar� application for° a VARIANCE, as stated on Page 2, and
WHEREAS the applican� has NOT met �he burden of proof required
to support his said application, and
WHEREAS the Planning Commission find� that the application does
NOT meet a11 of the fol�owing �°eq�airements:
1, That the�°e a�°e special conditions o� exceptional character-
istics in the natur°e of the property to be affected, or
that its loca�ion or its �u�°iroundings a�e �uch as will per-
mit the Commission �o make a determination that a literal
enforcement of the r�dinance would result in practical
difficultie� or unn�ces�a� hard�hips; an�
2. That the g�°anting of the application is necessary for the
preservat ion a�nd enjoymer�t of substan� i al property r i ghts,
and
3, Tha� the gr°anting of the application will not materially
affect adver�sely the health or safety of per�ons r°esiding
or wo� in the neighborhood of the property which is
the subject of the application, and that the use of said
p�oper i n the manrser wh i ch i t i s pr°oposed to be used
will not be materially detrimental to the public welfare
or inju�ious to the value of the property or improvements
located in said su�
NOW, THEREFORE� BE IT �ESOLVEDa
That afte� careful conside� of maps, facts, exhibits and
other evidence submitted in this matter, the application for
the VARIANCE be, and the same i�, he�°eby NOT recommended for
approval to the City Council of the City of Cupertino; and
BE IT FURTHER R�SOLVED;
That the findings q�;eted above and on Page 2 are approved and
adopted, and that the Secretary be, ar�d is hereby, directed
to notify the pa�ties affected by this decision,
