ADDRESS: 20430 Town Center Lane, Cupertino, California SUBMITTED: March 24 1969 LOCATION: East end of Pa1m Avenue, between Blackberry Farm and the Horse Ranch ZONE: Rezoned from Rl-`7.5 to R1C-6 AREA: 11.64 acres -------------------------------------------------------------------------------- l�pplication 10-Z-69, accompanied by a Development Plan and a Declaration of Covenants, Conditions and Restrictions as an integral part of the application, has been denied by the Planning Commission but granted by the City Council. The application has been referred ba�k to the Planning Commission for comments and possible suggestion of conditions. The Planning Commission reports that the Commission has reviewed this matter, and has no recommendations except that the saine conditions be imposed on Rezoning 10-Z-69 as on Tentative Map 12-TM-69. These conditions are: 1-12 Standard Conditions 13 There shall be an one hundred and twenty �120) ft wide flood control right-of-way along Stevens Creek, as shown on the Tentative Map. Ninety (90) feet of this width sha11 be dedicated in fee to the Santa Clara County Flood Control District. On each side of these 90 feet there shall be dedicated a fifteen (15) ft wide access easement to be kept clear and open and available to the Flood Control District for maintenance purposes; these easements shall also be accessible to fire vehicles, if required by the Central Fire Protection DisCriet. 14 There shall be a connection from Scenic Boulevard to the Flood Control easement. 15 There sha11 be an easement at least twenty (20) ft wide for access to lots along Riviera Road (a "paper street"�. 16 The number of parking spaces shall be thirty eight (38), as shown on the Development Plan (rather than 28 as shown on the Tentative Map�. 17 Private roadways within the development shall be constructed to City standards, except for width, to the satisfaction of the Director of Public Works. 18 There sha11 be no modifications of the Declaration of Covenants, Con- ditions and Restrictions attached to the application, except after consent by the City Council of the City of Cupertino. --------------------------------------------------------------------------------- (continued on Page 2 -1- 80,000.6 10-Z-69 RESOLUTION N0. 656 (MINUTE ORDER) (continued) PASSED AND ADOPTED unanimously (Commissioner Hirshon absent) this 9th day of June, 1969, at a regular meeting of the Planning Commission of the City of Cupertino, State of California.
