OF THE PLANNING COMMISSION OF THE CITY 0� CUPERTINO
to refer to the City Attorney the legal aspects of
the fo�low'ing problem:
The land of the Cupertino Union Church, located adjacent to the Post Of�ice,
is partly zoned General Commercial (CG) and partly Single-family Residential
10,000 sq. ft. lots (R1-10) (churches being regulated by u�e permits rather
th�n zoning). The land of the Post Office is zoned Gener�l Commercidl.
The Church wants to lease part of its R1-10 land to the Post O�fice, to be
used as a parking lot for employees. It seems that if the area had been
leased to a regular commercial enterprise, a rezoning to General Commercial
would have been required. Would the lessor's status as a non-pro�it organi-
zation or the lessee's status as a government agency jus�ify an exemption
from that requirement?
