RESOLUTION OF THE PLANNBNG COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached applica�ion has been submetted to the City�of Cuper-
tino requesting a change of zone in the zoning reg�lations of the City,
as stated on Page 2; and
WHEREAS the Planning CommessAOn has held at least one publs� hearing in
regard to the application on the date as noted on saed application; and
WHEREAS the Planning Commession has duly considered and heard all evidence
submitted in regard to sasd application; and
WHEREAS the necessary public �otices hav� been given as �equired by the
Zon�ing Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED:
l. That the Planning Commission finds that the proposed zone change:
a. Encourages the most appr�priate use of land,
b. Conserues and stabilezes the value of property,
c. Provides for adequate o��n spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the heal�h, safety and public welfare,
f. Provides for the orde�ly development of the City,
g. Is advantageous to the property and improvements in the zoning
district and nesg�borhood in which the prope�ty is located.
2. That said Planning Comm�ssion, therefore, reports favorably to the
City Council in the ma�ter of granting said zone change. Said
approval to be subject to the follow�ng conditions:
Exhibit "B", which as composed of Conditions 1-12 quoted below:
1. Install ornamental street lights, All lighting shall be designed
to in no way interfere with adjacent residential district.
2. Street trees will b� planted in the public right-of-way and shall
be of a type approved by the City in places designated by the City.
3, Traffic control signs will be placed at locations to be specified
by the Ci�y.
4. Fire f��ydrants shall be located as requested by the City.
5. A masonry wall will be built separating any commercial area from
any residential area; which wall shall be six feet high above the
highest adjoining finished grade.
6. All parking areas and drsveways will be paved as shown on the plot
plan.
7e Curbs, gutters, sidewalks, and structures shall be installed to
grades and be constructed in accordance weth standards specified
by the Cety Engineer.
8. Drainage within and without the development shall be to the sat-
isfactson �af the City Engineer,
9. Street improvements abutting the applicant's property shall be
according to City star�dards and specificationss
10. The applicant shall be responsible for completing site as shown
on approved plot plan and shall be required to pay for required
engineering, checking and inspectson, fees prior to issuance of
Building Permit.
11. Landscaping shall be as approved and masntained as shown on plot plan.
12. Street widening and dedications shall be in accordance with street
widths approved by City Engineer,
