APPLICATION SUMMARY

Typically, Director Minor Modification a pplications are approved by the Director of
Community Development. However, in this case the proposed minor modification is
being considered by the Planning Comm .ssion due to the concurrent height exception
proposal.
RECOMMENDATION
Staff recommends that the Commission a��prove the Director's Minor Modification and
Height Exception per the model resol �tions enclosed (Attachment 1). Planning
Commission action is final, unless appealE d to t�ie City Council.
BACKGROUND
The applicant, representing Clearwire, is �>roposing to install a personal wireless service
facility with antennas on top of a twelve-foot tall vertical extension of an existing 96-
foot tall PG&E lattice tower located betw��en a residence and a water tank on a hillside

property. Clearwire, a subsidiary of Clearwire Communications and Sprint-Nextel
Communications, is proposing to develop a new, high speed, wireless voice and
internet communications network in the San Francisco Bay Area and other parts of the
country.
The seven new antennas are proposed to be mounted at the top of a 12-foot tall vertical
extension to the PG&E lattice tower, which is located on a prominent ridgeline
according to the City's Residential Hillside Zoning (RHS) zoning ordinance. The
maximum proposed height of the tower will be 108 feet. The surrounding properties
are characterized by open hillside lands, with several accessory/utility structures and
other hillside residences (See aerial diagram below).

DISCUSSION
Location/Setback
The proposed antenna project complies v� ith the City's Wireless Facilities Master Plan,
which prefers personal wireless facilities to be located in non-residential areas.
However, if the facility is located in a re� idential area, the preference is mounting the
equipment on existing tall structures, suc h as a lattice tower. Further, the Cupertino
Wireless Facilities Ordinance permits wirE�less facilities in the RHS zoning district to be
mounted on an existing utility pole or tov�er, regardless of zoning district or setback to
a residential property line, as long as the facilities comply with federal exposure
standards for radio frequency energy.
Desi�nn/Height
The proposed antennas could only be mot.nted above the lattice tower in order to avoid
the high voltage transmission lines. Mo anting the antennas on the tower legs below
the lowest transmission line (below 55 fe��t) is not desirable due to the potential radio
interference from the trees growing arot�nd the base of the tower and the potential
visual impacts to the residents in the vicin: ty.
Ri�eline Visibiliti�
Development on prominent ridgelines as defined in the Residential Hillside (RHS)
zoning ordinance requires additional visual analysis from six, key valley floor vantage
points. The objective is to determine if the proposed development will create a
significant visual impact as viewed from any of these valley floor locations: Carmen
Road and Bellevue Road; Rainbow Dr. �ind Weymoth Dr.; Bubb Road & McClellan
Road; Hyannisport Dr. and Linda Vista L�r.; Foothill Blvd. & Starling Dr.; and Foothill
Blvd. & Alpine. Typically, the ridgeline �uidelines pertain to new developments that
involve buildings. Since the proposed a�ltenna project is located on top of a modest
addition to an existing lattice tower, : Zo additional visual impacts are expected
especially as viewed from the valley floor vantage points (See visual analysis -
Attachment 3).
As a condition of this project, the applic�int is required to paint all tower equipment,
(including but not limited to, cables, mour�ting hardware and antennas) a flat grey color
to visually blend the equipment with the i ower.
Below is a list of similar projects with co�nparable height exception requests on lattice
towers that the Planning Commission has supported and approved in the past:
1. Monta Vista PG&E substation at California Oak Way
(94 feet tall, file no. EXC-2005-17; 157 �ind 158 feet tall, file no. EXC-2009-08);
2. PG&E substation at Homestead Road r�ear Stelling Road
(94.3' and 85.5 feet tall, file no. EXC-20�8-1�;
3. 10655 Mary Avenue lattice tower
(148,149 feet tall, file no. EXC-2009-Oi );

Staff supports the project and the height e;cception request for the following reasons:
1. The project is consistent with the Wire: ess Master Plan policy that articulates the use
of existing vertical structures when w ireless facilities are proposed in hillside and
residential areas.
2. Proposed rectangular panel antennas visually blend in with the rectangular lattice
tower extension.
3. The visibility of the proposed circular �nicrowave dishes is minimized because of the
small size of the dishes and th��ir height above ground level (See the
photosimulations - Attachment 2).
4. Antennas located at the lower height� on the tower legs are likely to be subject to
radio interference from the trees gro�ving around the tower base and will create
greater visual impacts to nearby residEnts.
Radio Frequenc�� (RFE) Assessment
The applicant has commissioned the pre �aration of a Radio Frequency Energy (RFE)
report prepared by Hammett & Edison, Consulting Engineers (Attachment 4). The
report calculated the maximum effective ��adiated power, the RFE exposures at ground
level and at the second story of potenti�.l 2-story residences. The exposure data was
evaluated against the adopted federal exp��sure standards.
The report concluded that the proposed �'acility will meet the federal safety standards
for RFE of 1.0 mW/cm The calculat��d ground level exposure is 0.020% of the
applicable public exposure limit, and at th e second floor of any nearby building, 0.024 %
of the applicable public exposure limit. The exposure data includes the contribution
from the microwave dish antennas.
Since this project meets the federal safety standard for radio frequency energy, Federal
Telecommunications Law prohibits local governments from denying such a wireless
facility based on the environmental effec�ts of its radio frequency energy generation.
The attached chart depicts the RFE expos ures that are generated by various household
devices and compares it to a typical perso�lal wireless service facility (Attachment 5).
Additional Concerns
Several years ago, Sprint PCS proposed a wireless facility on the same PG&E tower,
which was eventually withdrawn by tr.e applicant. At the time, the surrounding
neighbors expressed concerns regarding �:onstruction related damage to the privately-
owned road. Staff has added condition; to the Director's approval to address those
concerns. They are requirements to:
1) Repair any visible road damage cat�sed by the construction activities, and
2) Mix the concrete on the property instead of transporting it to the site
(Attachment 1).

Public NoticinQ
Staff had previously mailed the plan set a�1d photosimulations to area property owners
for comments and received one objection. That application was eventually withdrawn,
but resubmitted several months later (th�� current application). Hearing notices were
mailed to property owners with land witr in a 1,000-foot radius of the project property.
No resident comments have been received to date.
TECHNOLOGY, INFORMATION ArID COMMUNICATION COMMISSION
(TICC) COMMENTS:
Per Ordinance requirements, Techn��logy Information and Communication
Commission provides technical advice to the Planning Commission on personal
wireless service facilities. The Tecrnology Information and Communication
Commission has designated two of its members to review and comment on pending
applications. Their comments are attach��d (Attachment 6). Both concluded that the
radio frequency energy exposure was well within the federal safety standards, that
mounting the antennas on the PG&E towE r will make them almost un-noticeable to the
general public, and the facility will serve �n area of Cupertino that historically has not
received any wireless communications coverage from any of the carriers.

SECTION I: FINDINGS
WHEREAS, the Planning Commission of the C:ity of Cupertino received a referral of a Director's
Minor Modification, as described in Section II �f this Resolution; and
WHEREAS, the necessary public notices hav e been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the P lanning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and

The Conditions of Project Approval set =orth herein may include certain fees, dedication
requirements, reservation requirements, a:1d other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions con�titute written notice of a statement of the amount
of such fees, and a description of the dedi��ations, reservations, and other exactions. You are
hereby further notified that the 90-day ap��roval period in which you may protest these fees,

3. ABANDONMENT
If after installation, the aerial is not used f�r its permitted purpose for a continuous
period of 18 months, said antennae and a�:sociated facilities shall be removed. The
applicant shall bear the entire cost of demolition and removal.
4. EXPIRATION DATE
This Director's Minor Modification shall expire ten (10) years after the effective date of the
permit. The applicant may apply for a rEnewal of the minor modification at which time the
Director of Community Development m��y review the state of wireless communication and
camouflage technologies to determine if the visual impact of the personal wireless facility
can be reduced.
5. CAMOUFLAGING OF EQUIPMENT
The antennas, mounting brackets, and cables that run from the antennas to the base
equipment shall be painted to match the �:olor of the lattice tower.
6. AVOIDANCE OF DAMAGE AND REP�.IR OF REGNART CANYON DRIVE
Prior to construction, the applicant shall conduct a photographic survey of all Regnart
Canyon Drive road defects and provide c�opies to the City and all affected property owners.
The applicant shall repair all noticeable damage caused by its construction activities.
In addition, the applicant shall not fi�ansport pre-mixed concrete to the project site.
Concrete for the equipment pad shall be �nixed at the project site.
7. DESIGN REVISION
The design shall be revised to vertically stack the panel and microwave dish antennas on
the members of lattice tower extension.

SECTION II: FINDINGS FOR EXCEPTION
WHEREAS, in order to provide heig ht flexibility in situations where practical
difficulties, unnecessary hardships or restilts inconsistent with the purpose and intent of
Chapter 19.108 occurs, an applicant for cievelopment may file an exception request to
seek approval to deviate from the standards; and
WHEREAS, the Planning Commission finds the following with regards to the Height
Exception for this application:
1. That the literal enforcement of the pi ovisions of this title will result in restrictions
inconsistent with the spirit and intent of this title in that the extra antenna height
above the ordinance maximum of .i5 feet is needed to avoid the obstructions
