PLEDGE OF ALLEGIANCE At 7:005 p.m. Chairman Robert Harrison callf;d the meeting to order and led the Pledge of Allegiance. ROLL CALL Present: Chairman Robert Harrison, and Commissioners Nancy Canter, KC Chandratreya, Michael Harkin. Absent: Jessi Kaur. Staff present: City Clerk Kimberly Smith. ORAL COMMUNICATIONS WRITTEN COMMUNICATIONS APPROVAL OF MINUTES 1. Harkin moved to approve the minutes of April 22, 2008. Canter seconded and motion passed unanimously with Kaur absent. PRESENTATIONS 2. Presentation from Hema Kundargi, Vice President of the Cupertino Library Foundation. Hema Kundargi indicated that the Library Foundation had approved art in the library and will be providing funding for a slat wall that can be used to accommodate the artwork without damaging the walls of the building. Hema suggested that the slat wall could be used to rotate art on a monthly or quarterly basis and requested support from the Commission to join the Foundation on tYiis project. Canter moved to collaborate with the Library Foundation to bring art into the library on a slat wall provided by the Foundation. Chandratreya seconded and motion pas:;ed unanimously with Kaur absent. Canter will work with Hema on rules and regulations for this project. NEW BUSINESS 3. Review of applications for Distinguished Artist and Emerging Artist of the Year. Harrison reviewed one application with the Commission for Distinguished Artist of the Year. Kaur moved to award Floy Vitti.n the Distinguished Artist of the Year. The Commission concurred not to award the Emerging Artist of the Year to the applicant. The Commission also concurred to change the age provision on the award application from 30 years and under to 13 to 30 years of age pending approval from the City Attorney. 4. Status of Budget Requests for 2008-09. City Clerk reported that she expected the Fine Arts budget to be approved for fiscal year 2008-09. UNFINISHED BUSINESS 5. Review of changes made to Percent-for-Art ordinance and "developer's guidelines" document. The Commission reviewed and edited the draft developer's guidelines prepared by Canter and Chandratreya. Canter will work with City Clerk to prepare a draft ordinance in addition to guidelines for staff and commission. The goal is to "create a civic environment where the arts express an innovative spirit, cE~lebrate a rich cultural diversity, and inspire individual and community participation." The policy serves to "stimulate opportunities for the arts through cooperative relations between local business and the City." One of the strategies for accomplishing the goal is to require public and private development of 50,000 square feet or larger to set aside .25% of their total project budget for on-site art. OVERVIEW • The goal sets an expenditure cap of $1.00,000, but developers are encouraged to spend more when necessary to provide aesthetic artworks of appropriate scale to their projects. • The developer will work with Building, Planning and Public Works staff, and must obtain overall project approval from the Planning Commission and/or City Council. The developer must obtain approval artwork approval from the Cupertino Fine Arts Commission before a building occupancy permit is issued. • The minimum expenditure for the artwork design, fabrication, and installation shall be equal to one-quarter of one percent (.25%) of the construction budget. Proof of the expenditure will be required. • The developer will be required to provide appropriate lighting, and to select landscaping materials which will best display the artwork. • The developer must provide appropri~ite signage for the art work, including the name of the art work, the name of the artist, ar~d the date. • Installation of the artwork, lighting, and signage must be completed before a Building Occupancy Permit will be issued. Developer has a preliminary consultation with Planning Department staff 2. Developer files a formal application 3. Plans are distributed internally to Planning, Building, Public Works, Fire, etc. Public Art Process 4. A public art requirement maybe triggered by the project's size, as set forth in General Plan Policy 2-66, or imposed as a conc'ition of approval by the Planning Commission and/or the City Council. Site plans for projects that require public art are distributed to affected parties, such as the Fine Arts Commission, Parks and F'ecreation Commission, etc. 5. Planning staff reviews all conditions of approval with the developer, including the Public Art criteria, and refers Developer to tl~e Fine Arts Commission (FAC) staff liaison. 6. FAC liaison schedules the matter before the FAC, and provides Developer with guidelines and application materials, ;3s well as a list of existing public art within the City limits. 7. A sketch and/or description of an identifying plaque, including its location in relation to the artwork. Note: The plaque shall measure at least 8"x 8", shall be constructed of a permanent material, and shall list the name of the artist, the title, and the date of fabrication Artist shall provide these items at the meeting: 1. A scale model and/or athree-dimensional virtual model 2. Samples of proposed materials for the art work and plaque 3. Care and maintenance plan recommended by the artist The Fine Arts Commission will review the proposal at a scheduled meeting and agree to the proposal as presented, or will continue the item and provide suggestions to the Developer/artist until the project meets their requirements. - 3 CRITERIA FOR REVIEW The Fine Arts Commission uses the criteria adopted by the Cupertino City Council on March 1, 2005, in the document titled "Selection of Public Art." Those criteria are as follows: • Aesthetics It is deemed an artwork of lasting aesthetic value that enhances the City's cultural environment by being receptive, respectful and stimulating and it contributes to the comprehensive record of visual arts for the community. • Artist's Background The artist's background will be reviewed to ensure he/she has the overall experience and knowledge to design, fabricate and install alarge-scale artwork. • Style The artwork shall be compatible in scale, materials, form and content with its surroundings. • Permanence Consideration will be given to structural and/or surface soundness, resistance to theft, vandalism, weathering and maintenance and repair costs. • Liability Proposed artwork will be examined for safety conditions and factors that bear upon public liability. • Accessibility Requirements The art work shall meet accessibility requirements as set forth under the Americans with Disabilities Act. • Visibility It shall be in public view in locations accessible to all members of the community, and should have a visible impact at a distance of not less than 100 feet and from moving vehicles. • Duplication Preference will be given to original, one-of-a-kind art work not duplicated in Cupertino or nearby communities • Preference Preference will be given to artists living or working in the San Francisco Bay Area and artists whose work is not already displayed as public art in the Cupertino area.
