RECOMMENDATION: Staff recommends "that the Planning Commission approve application. M-2008-05. BACKGROUND: In October. 2008, Apple Inc. received an approval from the City for an interior and minor exterior' tenant improvement to the existing o11e-story "Mariani 3" industrial" building located at 20400 Mariani Avenue. The tenant improvement work is underway; however Apple is requesting approval for a shared parking agreement with the adjacent property to the west. The adjacent "lot consists of an existing four-story "De Anza 3" office building also occupied by Apple. A common. parking lot ex.ists between and around both buildings. 1-1 Application: M-2008-05 Shared Parking Agreement 20400 Mariani Avenue and 10500 North De Anza Boulevard Page 2 Per the Cupertino Municipal Code Section 19.100.040 (F) (2), shared parking plans require Planning Commission review and approval. A modification to the original Use Permit (1l-U-77) is also required to memorialize the proposed shared parking arrangement. DISCUSSION: Shared Parking The following parking totals were calculated for the proposed building tenancies: Building Square Parking Parking Delta Foota ' e Code-Re uired Su I Mariani 3 (office) 107,564 377 348 -29 De Anza 3 (office) 213,088 748 814 +66 Total Parkin 1,125 1,162 +37 Base on the parking ratio for office buildings in Table 19.100.040 (A) of the Cupertino Municipal Code, each building requires one parking space per 285 square feet of building area. Mariani 3 is parking deficient by 29 spaces, while the adjacent De Anza 3 building has a surplus of 66 parking spaces. With a shared parking agreement, there would be a total surplus of 37 parking spaces between the two buildings. Staff supports the proposed shared parking arrangement. As a condition of this project, a covenant shall be recorded prior to issuance of final building occupancy, stating that the De Anza 3 building agrees to share their surplus parking spaces with the Mariani 3 building. Additional Parking Demand Management Measures To offset the demand for parking, Apple Inc. provides a variety of voluntary alternative transportation options for their employees including: free shuttles to and from Cal Train and ACE Train stations, commuter coaches, intercampus shuttle service to employees in the Cupertino area, a monthly transit subsidy, a carpool matching service, and emergency rides home. Environmental Review The project is categorically exempt from environmental review. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the exception to the parking regulations is hereby approved subject to the conditions which are enumerated in this Resolution; and SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. MODIFICATION TO USE PERMIT ll-U-77 A. This modification approval is granted to allow a shared parking agreement between the "Mariani 3" building at 20400 Mariani Avenue and the "De Anza 3" building at 10500 North De Anza Boulevard. B. A covenant shall be submitted for review and approval by the City and shall be recorded on both properties (20400 Mariani Ave. and 10500 N. De Anza Blvd.) prior to issuance of final occupancy for the Mariani 3 building. 2. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and ~ description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application M-2008-05, as set forth in the Minutes of the Planning Commission Meeting of November 25, 2008 and are incorporated by reference herein. Apple Offers The following to All Cupertino based Apple regular employees. The goal of the program is to offer a number of options for commuting to work that are synergistic with, and support the use of, existing public transit options and also offers an Apple specific transit solutions as well. Free Shuttles for employees from pubic transit: 2 Free shuttles are offered to employees using Cal train or ACE Train One shuttle From Mt View Cal train station to Apple serving employees commuting from (SF/Peninsula). The other from the Great America ACE Train station serving Employees from the East Bay, Pleasanton, Livermore, etc Commuter coaches Apple offers dedicated motor caches for employee living in several remote metropolitan areas to and from the Cupertino campus buildings. Currently this service (which began in 2007) extends to San Francisco, Gilroy-Morgan Hill, Berkley/east bay, and Pleasanton. These coaches serve over 500 employees daily. Intercampus shuttle Apple offers a free intercampus shuttle service to all employees in the Cupertino Area. Offering the ability to travel between remote building in a timely manner removes one of the hurdles to "leaving you care at home". This shuttle operates daily M-F from 8 am to 6pm. Transit subsidy Employees may apply for an receive up to $100 per month to offset their daily commute cost of using public transpositions such as buses, train, or van pool. This subsidy is provided to employees Monthly. Transit information is also provided to all Apple employees via the companies Intranet and transit information center located in several Apple buildings. These Center include information on Bus Routes and schedules, Train Routes and schedules, Apple shuttle schedules and other transit related information for commuters. Carpool matching service Commute alternative offers an Apple specific carpool matching service for Cupertino Based employees to help match employees from the same "neighborhood" to connect and carpool to work.
