OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A
REQUEST TO REMOVE ONE TWENTY-INCH DIAMETER BLUE ATLAS CEDAR TO
BE REPLACED WITH ONE THIRTY-SIX INCH BOX DEODAR CEDAR.

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application
to remove one Blue Atlas Cedar tree and replace it with one Deodar Cedar, as described
in this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support removal of
the tree and has satisfied the following requirements:
1) The Blue Atlas Cedar, due to structural damage and poor health, is unsuitable for
retention.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, application for Tree Removal is hereby approved as modified;
and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the Public Hearing record concerning
Application TR-2003-06, as set forth in the Minutes of the Planning Commission
Meeting of May 27, 2003 are incorporated by reference herein.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVAL ACTION
The applicant may remove one Blue Atlas Cedar tree, noted as Tree #2 on an
arborist report prepared by Barrie D. Coate and Associates. One 36" box Deodar
Cedar shall be planted as a replacement in the front yard area along Santa Lucia
Road.
2. ARBORIST SUPERVISION
A certified arborist from Barrie D. Coate and Associates shall be on-site during all
work involving the driveway and public improvements.
� 3. REDWOODS
'� Redwood trees along the southerly side property line shall be retained.
4. COVENANT
Prior to the final occupancy of the new residence, the applicant shall record a
covenant on the property protecting all Cedar and Redwood trees, and any
associated privacy planting trees from removal.

Planning Commission of the City of Cupertino by the following roll call vote:
