Reso 6119 19-ASA-01 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 6119 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AN ARCHITECTURAL AND SITE REVIEW FOR A FA�ADE IMPROVEMENT AND SITE AND LANDSCAPING IMPROVEMENTS. SECTION I: PROJECT DESCRIPTION Application No.: 19-ASA-01 Applicant: Crossroads Center (Kahn Design Associates) Location: 20568-20770 Stevens Creek Boulevard SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for Architectural and Site Approval, as described in this Resolution; and WHEREAS, the Planning Commission finds that the proposal is beneficial and compatible with the surrounding area; and WHEREAS, the Planning Commission finds that the proposal meets the following requirements: 1. The proposal, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; 2. The proposal is consistent with the purposes of the zoning ordinance, and the General P.lan, in that the design contributes to an enhanced pedestrian experience. 3. The proposal will use materials and design elements that compliment neighboring structures. 4. The proposal includes landscaping that will soften the appearance of the structure. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the Application No. 19-ASA-01, is hereby approved; and That the subconclusions upon which the findings and conditions specified in this Resolution axe based are contained in the public hearing record concerning Application 19-ASA-01 as set forth in the Minutes of the Planning Commission Meeting of December 10, 2001 and are incorporated by reference as though fully set forth herein. Resolution No. 6119 19-ASA-01 December 10, 2001 Page 2 SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on the submitted plan set entitled "Cupertino Crossroads Center" by Kahn Design Associates last revised December 5, 2001 and material board, except as may be amended by the conditions contained in this Resolution. 2. STAFF REVIEW PRIOR TO ISSUANCE OF BUILDING PERMITS The following items are subject to approval by the Director of Community Development prior to the issuance of building permits: ■ Installation of a driveway median and associated landscaping near the Footwear Etc. and Frame N Lens tenant spaces; ■ Pedestrian pathway materials; ■ Landscaping shall be added in front of the two large columns at the Pier 1 farade. If it is determined that there is insufficient space, the two columns will be reduced in size to provide sufficient room for landscaping; ■ The applicant shall modify the plan to provide a consistent human scale relationship between pedestrians and the heights of light fixtures and awnings; ■ Architectural and/or landscaping details shall be added to the north fa�ade (parallel to Stevens Creek Boulevard) of the Footwear Etc. tenant space and the tenant spaces east of Aaron Brothers. ■ The final landscaping plan will precisely note the species of proposed trees and plant materials; and ■ Any proposed minor architectural changes, including those necessary to address the items listed previously in this condition. 3. PEDESTRIAN PATHWAY ON EAST SIDE OF MAIN DRIVEWAY The applicant shall enter into a bonded agreement with the City for the construction of a pedestrian sidewalk along the east side of the main driveway. The design of the sidewalk is subject to the approval of the Director of Community Development. The sidewalk must be constructed within 2 years of this project's approval date, unless a future project supercedes this condition. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.
