OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A ONE YCAR
TIME EXTENSION FOR FILE NOS. 14-EXC-98(M) & 1-V-98, TO MAY 3, 2002. THE
EXTENDED APPROVALS ARE A HILLSIDE EXCEPTION .AND VARIANCE FOR AN
� APPROVED 3,102 SQUARE FOOT HOUSE, AND A PARKING VARIANCE TO ALLOW LCSS
THAN 4 FUNCTIONALLY INDEPENDENT PARKING SPACES IN ADDITION TO THC TWn

, SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application to extend the
duration of an approved Hillside Exception and Variance, as described in Section II of this Resolution;
� and approved by the City Council on Reconsideration at its meeting of May 3, 1999.
I WHEREAS, the necessary public notices have been given in accordance with the procedural ordinance
of the City of Cupertino, and the Planning Commission has held one or more public hearin�;s on this
matter; and
WHEREAS, the applicant has demonstrated compelling reasons for granting an extension in tllat:
1. The proposed development involves extraordinary site conditions including excessively steep
slopes, mature trees that will be preserved, and limited staging areas for construction.
2. The proposed development requires permits and easements across City streets and parklands,
which require lengthy negotiations with the City.
3. The proposed development requires specialized contractors which have limited availability.
4. The construction of the proposed development is extremely complex and requires a methodical
approach to be executed correctly. Additional time is justified.
5. The applicant has been working with City staff to start the construction process.
NOW, THEREFORE BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other evidence submitted in this matter, the
application for extension of the hillside exception and variance is hereby approved; and
BE IT FURTHER RESOLVED:
That the subconclusions upon which the findings and conditions specified in this resolution are based
are contained in the public record concerning application 14-EXC-98(M) and 1-V-98, as set forth in
the Minutes of the Planning Commission meeting of May 29, 2001, and are incorporated by retercnce
as though fully set forth herein.

3, 2001 and expiring on May 3, 2002.
