OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING AN ARCHITECTURAL REVIEW OF THE MATERIALS, COLORS,
LANDSCAPING, LIGHTING AND OTHER DETAILS FOR AN APPROVED HOTEL AT CITY
CENTER
SECTION I: PROJECT DESCRIPTION
Application No.: 6-ASA-O 1
Applicant: Kimpton Hotel & Restaurant Group
Location: Lot 6, Tract 7953 at City Center
SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for an
Architectural and Site Approval, as described in this Resolution; and
WHEREAS, the Planning Commission finds that the changes are beneticial and compatibte with the
surrounding area;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence subinitted in this
matter, the application no. 6-ASA-01, is here by approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the public hearing record concerning Application 6-ASA-01 as set forth in the
Minutes of the Planning Commission Meeting of February 26, 2001, and are incorporated by referencc
herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMCNT DCPT.
1. APPROVED EXHIBITS
Approval is based on the submitted plan set and material board, exept for revisions shown in
Exhibits D and E.
2. HEDGE REMOVAL
The low hedges at the intersections of De Anza Boulevard/Cali Avenue and Armadillo Willy's
parking lot exit shall be removed for sight line visibility.

Maintenance of all landscaping, sidewalks and light fixtures between the curb and the buildings
on both sides of Cali Avenue is the responsibility of the property owner.
The sidewalk shall be 6.5 feet wide and the planting strip five (5) feet wide on the north side of Cali
Avenue.
4. SIGNS AND BANNERS
The signs are not a part of this approval, and will need to be approved through a separate
architectural and site approval application. The banner on the street light is not approved.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications; reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. [f
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
