Required Artwork
●Development of ten thousand sq. ft. or larger
●New buildings and/or the expansion of
existing buildings
●Westport development approved August of 2020.

●The Oaks:Created by Eric Powell,these
five (5)benches located along the south
façade of the senior affordable housing
building facing Stevens Creek Boulevard.
●Kaleidoscope Dreams:Created by Reed
&Madden,the stainless steal structure
topped by twelve (12)steel laser cut
butterflies will be adjacent to a butterfly
garden fronting Mary Avenue.
What is considered artwork?
●Sculpture: in-the-round, bas-relief, mobile, fountain, kinetic,
electronic, or other, in any material or combination of
materials;
●Painting: all media, including portable and permanently
affixed works, such as murals;
●Graphic arts: printmaking, drawing, calligraphy and
photography, but only when on a large public scale;
●Mosaics;
●Functional artwork: created by a professional artist, such as
benches, tree grates or trash receptacles;
●Any other form of work of art determined by the Arts and
Culture Commission to satisfy the intent of this chapter.
What is NOT considered artwork?
●Reproductions of original works of art;
●Directional or other functional elements such as
supergraphics,signing,or color coding,except where
those elements are integral parts of original signed
artworks;
●Art objects which are mass-produced from a standard
design;
●Landscaping and garden features,except where these
elements are designed by the artist and are an integral
part of a fine artwork.
What is the value?
●1% of the first $100 million of
construction valuation.
●0.9% of construction valuation for
valuation in excess of $100 million.
What criteria is considered when
reviewing the art pieces?
●Artwork integral part of landscaping/architecture of the
buildings;
●Easily visible from public street and be located in an area
specifically designated on site plan;
●Permanent materials requiring a low level of maintenance;
●Preference to artists living or working in the San Francisco Bay
Area
●Avoid artists whose art already displayed as public art
within the City of Cupertino boundaries
●Expressions of obvious bad taste or profanity shall not be
approved;
●Artwork shall be identified by an appropriate plaque or
monument
Recommendation and Next
Steps
●Receive a presentation on a public art installation for the
Westport Development and approve public art application,
subject to conditions of the draft resolution.
●The decision of the Arts and Culture Commission is final, unless
appealed within 14 calendar days from the date of the hearing.

●24 Projects Included
●15 approved for funding
●9 on hold
●City Council reevaluating all City Work Program
items in Spring 2024.
●Commissions review existing work program items
and propose up to three (3) items for Council to
consider.
FY 2023-2025 City Council Work
Program
●Nine Items Currently on hold –(Attachment A)
●Items that were not selected during the
prioritization process -(Attachment B)
●New Items:
●Timelines are finite in nature, with an expectation of completion within the
next 1-2 fiscal years.
●Items are not duplicated in other efforts/programs like Capital
Improvement Program (CIP) projects, General Plan, Climate Action Plan,
etc.
●Items are not part of general City operations.
●Items fit into at least one of the five Council approved Goals (Public
Engagement and Transparency, Transportation, Housing, Sustainability &
Fiscal Strategy, Quality of Life).
●Items fit within the Commission’s scope outlined in the Cupertino
Municipal Code.
Arts and Culture Commission
Scope CMC 2.80
●Act as a catalyst for the promotion of arts and culture activities;
●Keep current on potential arts and culture activities which would be available to the
community;
●Provide liaison between various arts and culture activities;
●Provide a means for coordination for arts and culture groups or facilities which may exist
within the community;
●Maintain an inventory of facilities available for related arts and culture activities within
the community;
●Provide screening and/or review for arts and culture activities wishing to obtain city funds
or utilize public facilities;
●Provide information to the community relating to the arts;
●Foster the development of public art within the community;
●Be vigilant in exploring and advancing the range of arts and culture activities available
to the community;
●Enhance the interaction between arts and business;
●Any other activity which may be deemed appropriate and necessary.
Final Recommendation
All proposals must be submitted using
Attachment C. These proposals will
be consolidated and submitted for
Council consideration in early spring.
